Employment of Youths

Overview

There is no general minimum age for employment, but there are some important rules about the employment of young people. 


Young people aged less than 16 years are legally required to attend school. Employment must not prevent or interfere with school attendance.


Young people aged less than 16 years must not work after 10 pm or before 6 am.

Guidelines

To help keep young people aged less than 15 years safe, there are some extra rules about the type of work they can do and the places where they can work:


1. Young people aged under 15 years old, cannot work in any area at their workplace while:

  • Goods are being prepared or made for sale
  • Any construction work is being done
  • Any logging or tree-felling work is being done
  • Any other work is being done in that area that is likely to harm them

     NB: This doesn’t apply if they work at all times in any office in that area, or in any part of that area used only to sell things.

 

2. Employers must ensure that young people don’t work or assist with work involving machinery. This includes using any powered tool or appliance.

 

3. Employers must ensure that, if someone is aged under 15 years old, while they are in the workplace they do not:

  • Drive any vehicle; or
  • Ride on any vehicle while it is towing or is attached to anything; or
  • Ride on anything towed by or attached to any vehicle.
     NB: A “vehicle” means any tractor and any vehicle, other than a car, a truck, a motorcycle, or machinery that weighs 700 kilograms or less.
